On March 21, 2019, a notice was published in the BORM announcing a joint resolution between the General Directorates of the Environment and Mar Menor, Public Health and Addictions, Agriculture, Livestock, Fisheries and Agriculture, and Natural Environment, regarding burning practices in the agricultural sector.<\/p>\n
Pursuant to this resolution, residents of Cieza are informed that, according to said resolution, the practice of burning straw to prevent frost is not permitted under the combined terms of Law 22\/2011, of July 28, on waste and contaminated soil, and Law 34\/2007, of November 15, on Air Quality and Atmospheric Protection.<\/p>\n
According to the same resolution, the burning of agricultural plant waste is a practice\u2014generally not permitted by Law 22\/2011, of July 28, on waste and contaminated soil\u2014and only exceptionally permitted in the case of pest control, in accordance with the provisions of Law 43\/2002, of November 20. In this case, it must be carried out using means or procedures that do not endanger human health or harm the environment.<\/p>\n
Therefore, and taking into account the provisions of article 25.2.b. of Law 7\/85, regulating the Bases of Local Government, which establishes that the Municipality will exercise in all cases as its own powers, among others, "Urban environment: in particular, public parks and gardens, management of urban solid waste and protection against pollution" acoustics, lighting and atmosphere in urban areas<\/strong>"as well as that established in the sectorial regulations, especially Law 22\/2011, on waste and contaminated soil, which attributes powers to the local administration in the field of domestic waste management, Law 43\/2002, of November 20, on Plant Health and Law 34\/2007, of November 15, on air quality and atmospheric protection<\/p>\n This is why it is reported:<\/strong><\/p>\n It is necessary to clarify the authorization regime and the action protocol that the signatory General Directorates plan to establish outside the urban area, where the powers of this administration end and\/or in the case of non-domestic waste, and taking into account the supra-municipal nature of the problem and the doubts and uncertainties that certain issues in said resolution have raised among the municipality's residents.<\/p>\n Based on the above, the Cieza City Council, through its Mayor, will urgently request the President of the Federation of Municipalities of the Region of Murcia, as the representative body of all the municipalities in the Region, to clarify with the competent regional bodies any doubts arising from the publication of this resolution.<\/p>\n In any case, this administration, and as is inevitable, will guarantee compliance within the scope of its own powers established in the basic and sectoral regulations, that is, in the urban area and\/or in the event that substances classified as domestic waste are used or employed for an unauthorized purpose.<\/p>\n Until such clarification is provided, and for any issue affecting non-urban areas or involving the use of substances not considered household waste, interested parties should contact any of the signatory directorates-general.<\/p>","protected":false},"excerpt":{"rendered":" Con fecha 21 de marzo de 2019 se publica en el BORM anuncio por el que se da a conocer Resoluci\u00f3n conjunta entre las Direcciones Generales de Medio Ambiente y Mar Menor, Salud P\u00fablica y Adicciones, Agricultura, Ganader\u00eda, Pesca y Agricultura, y Medio Natural, en relaci\u00f3n a pr\u00e1cticas de quemas en el sector agr\u00edcola.
